User Terms
These Terms and Conditions ("Terms") govern your use of the wasapbos platform, a comprehensive WhatsApp Marketing service (the "Service"), provided by Instant Media Publisher ("wasapbos," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms.
1. ACCEPTANCE OF TERMS
1.1. Legal Capacity: You represent that you are a business entity or an individual of legal age to form a binding contract.
1.2. Service Scope: wasapbos provides tools for managing WhatsApp marketing campaigns, bot integration, template management, and contact database management.
2. USER RESPONSIBILITIES AND COMPLIANCE
2.1. WhatsApp/Meta Compliance: You acknowledge and agree that your use of the Service is subject to, and requires compliance with, all applicable laws, rules, and regulations, including the WhatsApp Business Policy and Commerce Policy (collectively, "WhatsApp Policies").
2.2. Consent and Opt-in: You are solely responsible for obtaining and maintaining valid, verifiable opt-in consent from all recipients before initiating any communication using the Service, as required by WhatsApp Policies and all applicable communication laws (e.g., GDPR, CCPA, TCPA).
2.3. Prohibited Content and Use: You shall not use the Service to transmit spam, unlawful, harassing, defamatory, or abusive content. Use of the Service for illegal activities or activities violating WhatsApp Policies (e.g., selling prohibited goods) will result in immediate termination.
2.4. Data Integrity: You are responsible for the accuracy and legality of all data, contact information, templates, and content you upload, transmit, or manage through the Service.
3. ACCOUNT AND TEMPLATE MANAGEMENT
3.1. Account Security: You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
3.2. Template Use: While wasapbos facilitates the creation and management of message templates in-app, you acknowledge that all template approval is ultimately controlled by Meta/WhatsApp, and wasapbos is not responsible for the rejection or delayed approval of any template.
3.3. Team Members: You are responsible for the actions of any team members or agents you grant access to your wasapbos account.
4. SUBSCRIPTIONS, FEES, AND PAYMENT
4.1. Subscription: Access to the Service is provided on a subscription basis as outlined in our Pricing structure.
4.2. Third-Party Charges: All subscription fees for wasapbos are exclusive of, and you are solely responsible for, any external charges, including but not limited to:
a) **WhatsApp Cloud Messaging Charges:** Fees assessed by Meta/WhatsApp for message conversations.
b) **Payment Processor Fees:** Fees associated with our third-party payment processor, Stripe, for subscription and recurring payments.
4.3. Billing: Payments are processed via Stripe and others. By providing payment information, you authorize wasapbos and Stripe and other payment gateways to charge you for all applicable fees.
5. AI BOT INTEGRATION
5.1. AI Functionality: The Service offers AI bot integration. You acknowledge that AI responses are generated automatically and may occasionally be inaccurate, inappropriate, or incomplete.
5.2. Responsibility: You are responsible for reviewing and configuring all AI bot flows and settings (including bot timing restrictions) to ensure they meet your operational and legal requirements.
6. TERMINATION
6.1. Termination by wasapbos: We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms, including but not limited to, violations of Section 2 (User Responsibilities) or failure to pay fees.
6.2. Termination by User: You may terminate your subscription at any time via your account settings. No refunds will be provided for any unused portion of a subscription period, except as expressly stated in a separate refund policy.
7. LIMITATION OF LIABILITY AND DISCLAIMER
7.1. Disclaimer: The Service is provided "as is" and "as available," without warranties of any kind. wasapbos does not warrant that the Service will be uninterrupted, error-free, or secure.
7.2. Limitation: To the maximum extent permitted by applicable law, wasapbos shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, resulting from your use of the Service.
8. GOVERNING LAW
These Terms shall be governed by the laws of Malaysia without regard to its conflict of law provisions.
